I've just been reading that the public prosecutor is reviewing whether to take action against the British family who restrained a burglar at their property.
I wonder if anyone knows what the law is in Spain regarding this?
I know if I found a burglar in our house they wouldn't be treated with respect for their wellbeing!!

The burglar did die, so a bit of a difference then just restraining someone. Of course it need looking into properly.
You cant kill people! Like the case in the uk of the farmer shooting the burglar in the back as he was fleeing.

Would you be expected to know the burglar possibly had a heart condition?
I'd throw them down the stairs, that marble isn't very forgiving, and ask questions once I thought they were no longer a threat to me or my family

Yes of course I agree, if they are a threat do all you can.
And I suppose the police are always killing people while restraining them and they are trained......

I'm with the common man here break into my house your fair game ... The U.K. Law on this has just been changed and judges now have to consider the threat and terror of the people in the house etc.. But as far as I'm concerned if you go out to commit a crime like this and end up like this guy did then tough !!!!

People who are restrained quite often have drink,drug and serious health problems caused by the drink/drugs making them behave badly in the first place.
And then people moan about them being restrained!

Please don't get me wrong...we should and would, do all to protect our house and family ....would i strangle someone to death...no....do the police routinely do this...yes (and they are trained about Positional asphyxia )

A lot of people who come into custody have serious illnesses brought on by lifestyle choices, in the case of Police custody a lot are drunk and or under the influence of drugs when arrested. So how are the Police supposed to know a persons medical history barring everyone carrying their doctors notes in their back pocket?. Also Police are by their very name Police and not medical staff so are not trained to the same level to recognise the early symptoms of serious medical problems. People die in Police custody but are not killed by the Police but die from medical problems. This is being slowly rectified by nurses being in custody suites. So saying Police kill people in custody is untrue, they just die there a bit like people die in hospital.
