I've just received the details of our status re claiming the retention back from our solicitors in Spain.
To obtain the Purchase Price of your property you add; the purchase price as shown on the Escritura, plus ; IVA, Mod600, Notary Fees and Registration Fees.....in our case these "incidentals" added over 13,000 Euros to the Escritura purchase price. You must have all the official receipts for these items.
The Selling Price of your property is: the sale price as shown on the Escritura minus Estate Agents fees, again receipts required.
Your liability to Capitol Gains is obviously Purchase Price minus Selling Price.
Our solicitor has looked after our affairs from buying the house to selling it and has all these receipts and knows that all our yearly tax bills have been calculated and paid correctly.........so now the claim for our 3% has been submitted we have to wait anything from 3 to 24 months to get it back.
